INTERESTING DECISION ON TUPE
Scottish Court decides that an employee’s right to participate in a share scheme transfers under TUPE
In a recent decision of the Scottish Court of Session, Ponticelli Limited v Gallagher [2023] CSIH 32, it was held that a share incentive plan transferred under TUPE in a situation where the employee’s right to participate in the plan was not set out in the contract of employment.
